BAA Statement on the pronouncement of the Court of Appeal

In accordance with the provisions of article 82 of the Securities Market Law (Ley del Mercado de Valores), GRUPO FERROVIAL, S.A. hereby notifies the Spanish Securities Exchange Commission (Comisión Nacional del Mercado de Valores) of the following:

BAA Statement

“We are disappointed that the Court of Appeal has upheld two of the five grounds argued by the Competition Commission”.

“We note the Courts view that apparent bias in relation to a panel member existed during part of the Commissions investigation and will study this judgement carefully”.

“We will be seeking permission to appeal to the Supreme Court”.
